Terms and Conditions

by booking a lesson or making a purchase with us, you agree to our terms and conditions. 

before you make or use any purchase made through our website, please make sure that you have read through, understand and agree to our terms.

we reserve the right, at our sole discretion, to amend our terms and conditions at any time and will update these terms of service in the event of any such amendments.

we will notify you of material changes to our terms, such as price changes, at least 14 days prior to the change taking effect by posting a notice on our website and in-studio.


by purchasing and booking your lessons at our studio, you acknowledge that you understand and agree to our terms.


booking your lesson

  1. all lessons must be booked and paid more than 24hr in advance

cancellations

cancellations / no-shows:  1-to-1 lessons

  1. we have a 24hr cancellation policy.

  2. any lesson cancelled more than 24hr in advance will be posted back to your account and available to rebook before its expiry date.

  3. your lesson will be treated as used, whether or not you attend, if you give us less than 24h notice to cancel your lesson.

  4. we reserve the right to substitute your teacher without notice.

  5. we reserve the right to cancel your lesson without notice and in this instance your lesson will be posted back to your account and available for you to rebook.

cancellations / no-shows: 2-to-1 lessons

  1. when one student cancels a 2-to-1 lesson, it is considered cancelled by both students.

  2. we have a 24hr cancellation policy.

  3. any lesson cancelled more than 24hr in advance will be posted back to your account and available to rebook before its expiry date.

  4. your lesson will be treated as used, whether or not you attend, if you give us less than 24h notice to cancel your lesson.

  5. we reserve the right to substitute your teacher without notice.

  6. we reserve the right to cancel your lesson without notice and in this instance your lesson will be posted back to your account and available for you to rebook.

cancellations / no-shows: courses of lessons

  1. you are buying a course as a complete purchase and individual lessons from that course, if missed or cancelled, can not be made up.

  2. if you give us more than 24hrs notice to cancel or reschedule your place on a course, you may select another course or service to transfer your payment to, if available, or request a refund.

  3. if you neglect to give us more than 24hrs notice to cancel or reschedule your course, it will be treated as having been used whether or not you attend and you will not be entitled to a refund or to reschedule.

  4. we reserve the right to substitute your teacher without notice.

  5. we reserve the right to cancel individual lessons from your course without notice and in this instance you will receive a refund for that lesson.

cancellations / no shows: group practice:

  1. we have a 24hr cancellation policy.

  2. any lesson cancelled more than 24hr in advance will be posted back to your account and available to rebook before its expiry date.

  3. your lesson will be treated as used, whether or not you attend, if you give us less than 24h notice to cancel your lesson.

  4. we reserve the right to substitute your teacher without notice.

  5. we reserve the right to cancel your lesson without notice and in this instance your lesson will be posted back to your account and available for you to rebook.

cancellations / no-shows: professional classes & professional practice

  1. we have a 24hr cancellation policy.

  2. any lesson cancelled more than 24hr in advance will be posted back to your account and available to rebook before its expiry date.

  3. your lesson will be treated as used, whether or not you attend, if you give us less than 24h notice to cancel your lesson.

  4. we reserve the right to substitute your teacher without notice.

  5. we reserve the right to cancel your lesson without notice and in this instance your lesson will be posted back to your account and available for you to rebook.

cancellations / no-shows:  teacher workshops

depending on the type/length of workshop on offer, specific terms relating to that workshop or course will be posted on our website along with details/description of that course/workshop.

for the avoidance of doubt, we do not offer refunds on workshop/course registrations with visiting teachers. If you register but are not able to attend, you may wish to transfer your place to another teacher, who meets the stated pre-requisites for that workshop/course.

expirations

your purchase is only valid for a specified period and any lessons or portions of packages purchased but not used before their expiry cannot be carried forward or refunded.

it is up to you to determine whether or not you will be able to use your purchase before it expires. we do not refund lessons not used before their expiry due to teacher unavailability (which is possible at peak times). At the time of purchase, book your full package to avoid disappointment.

expirations: 1-to-1 / 2-to-1 lessons

  1. single lesson purchases: 1 month from purchase

  2. 5 lesson packages: 2 months from purchase

  3. 10 lesson packages: 3 months from purchase

expirations: group courses

  1. course purchases will expire on the last day of their term.

expirations: group practice

  1. single lesson purchases: 1 month from purchase

  2. 5 lesson packages: 2 months from purchase

  3. 10 lesson packages: 3 months from purchase

expirations: professional classes / practice / teacher workshops

  1. professional class / practice purchases must be used within 3 months of purchase

  2. teacher workshops must be used for the specific workshop/date purchased

refunds

  1. you cannot transfer unused sessions or bookings without our permission. please, just ask us. such permission will not be unreasonably withheld.

  2. no refunds or extensions will be given for expired classes or packages.

  3. no refunds will be given for any unused portions of pre-paid package or course purchases. 

  4. no refunds will be given for teacher courses/workshops


your privacy

our privacy notice tells you what to expect when we collect your personal information.

our privacy notice does not cover any links within our site(s) linking to other websites.

personal data

personal data relates to any information, which can be used to identify you. the processing of personal data is governed by the data protection act 1998, which will be replaced in may 2018 by general data protection regulation (gdpr).

what we collect

when you sign up for and use bepilates' services, sign up to our newsletter, send us an email or communicate with us in any way, you are voluntarily giving us the information that we collect. that information may include your name, physical address, email address, ip address, phone number, credit card information, as well as gender, occupation, location, purchase history and other demographic information regarding your health. by giving us this information, you consent to information being collected, used, disclosed and stored by us as described in this privacy notice.

when you use our services or browse our website, we may also collect information about your visit to our website, your usage of our services, and your web browsing. that information may include your ip address, your operating system, your browser id, your browsing activity, and other information about how you interacted with our website. we may collect this information as a part of log files as well as through the use of cookies or other tracking technologies.

we may require you to provide information to us in order to enter into and perform our contract(s) with you or to comply with our legal obligations. except in these circumstances, your decision to provide personal information to me is generally voluntary and, where it is voluntary, you may choose to withhold and not provide personal information to me. if you choose not to provide certain information to me i may not be able to accomplish some of the purposes outlined in this policy.

children’s data

we do not knowingly collect or store any personal information about children under the age of 16 . we do not offer any of our products or services directly to children.

sharing your data

we may share your information to certain third parties, including:

  • teachers hired to cover your lessons/services at our studio,

  • external agencies and organisations (including the police and other law enforcement agencies) for the purpose of preventing and detecting fraud (including fraudulent transactions) and criminal activity and for the assessment and collection of tax,

  • our insurers and insurance brokers and their advisers in the event that a claim is made or could be made against us, or

  • third parties. we may share your information with third parties if we are under a duty to disclose or share your personal information in order to comply with any legal or regulatory obligation (including in connection with a court order), or in order to enforce or apply the agreements we have with or otherwise concerning you (including agreements between you and bepilates), or to protect our rights, property or safety of our other customers.

you should be aware that, we reserve the right, if requested by police, regulatory or government authority investigating suspected illegal activities, to share information concerning your activities whilst using our services or website.

processing your data

bepilates complies with obligations set out under the data protection act/gdpr by keeping personal data up to date; storing and destroying it securely; not collecting or retaining excessive amounts of data; protecting personal data from loss, misuse, unauthorised access and disclosure and by ensuring that appropriate technical measures are in place to protect personal data.

in relation to the above uses of your personal information and the above sharing arrangements, your personal information may be transferred to, and stored and processed in, one or more countries outside the european economic area (eea), including countries which do not provide equivalent protection for personal information.

storing your data

if we collected your personal information in order to perform a service or performance of a contract, we will keep your personal information for 3 years from the date of the last service you requested or booked with us.

we may also retain and use your information in order to comply with legal obligations, resolve disputes, prevent abuse, and enforce agreements.

keeping it safe

we take reasonable and appropriate measures to protect your data from loss, misuse and unauthorised access, disclosure, alteration and destruction, taking into account the risks involved in the processing and the nature of what information is held.

we will give you access to any information we hold about you within 30 days of any request for that information.

you are entitled:

  • to request access to your data,

  • to correct or update your data,

  • to delete your data,

  • to restrict or object to how i use your data, and

  • to move your data.

unless it is prohibited by law, i will remove your information from my servers at your request. there is no charge for an individual to access or update your data.
you are able to unsubscribe or withdraw consent about how we use your information at any time.

  1. information published on bepilates' website and mindbody booking site is provided for the use of bepilates’ visitors.

  2. please be advised that although care has been taken to ensure technical and factual accuracy, some errors may occur.

  3. please be aware that bepilates may alter the information on its website from time to time.

  4. bepilates shall have no liability arising from the use by any party of the information on this website.

  5. bepilates does not warrant the information on this website in any way and in particular, no warranty is given that the website or its contents or hypertext links are virus free or uncontaminated.

  6. you are advised to make your own virus checks and to implement your own precautions in this respect.

  7. bepilates takes no responsibility for contamination or damage caused by any virus or electronic transmission.
